Will and Power of Attorney in Spain: What English Speakers Need to Know
Marga Matas qualified as a lawyer in 1992 and practises in Mallorca, acting for English speakers across Spain. In this interview for Age in Spain she explains the difference between a will and a power of attorney, why both matter, and why age isn’t the deciding factor for either. She covers the different types of power of attorney, including the preventive one that only takes effect if you lose mental capacity, who people usually appoint and why trust is central, how the notary process works and what happens if the notary doesn’t speak English. She also explains whether a Spanish power of attorney holds good abroad, what the notary checks when someone has an early dementia diagnosis, why the courts become the only route once capacity is gone, and what a living will covers.
